Terms of Service

Effective date: June 29, 2026

1. Who we are and what these Terms cover

These Terms of Service (the "Terms") are a binding agreement between you and 21dcs spol s r.o., the company operating the FindMyClubs service ("FindMyClubs", "we", "us" or "our").

They govern your use of the FindMyClubs registration and message-forwarding service made available through our website and web application at findmyclubs.eu (the "Platform"). They do not govern your purchase of the physical labels — see clause 3.

By registering a QR code, creating an account, or using the finder function, you confirm that you have read and accept these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

2. Definitions

Term	Meaning

Service	The online registration and message-forwarding functions described in clause 5, provided by us for the Service Period.
Platform	The FindMyClubs website and web application at findmyclubs.eu.
Label	A physical adhesive label carrying a unique QR code, sold to end users by independent dealers and retailers.
Package	A set of Labels supplied together as a single product, containing a set number of Labels.
QR Code	The unique machine-readable code printed on a Label, together with its QR Code ID.
Owner	A user who registers a QR Code and uses the Service in respect of their own equipment.
Finder	A person who scans a QR Code, or enters a QR Code ID on the Platform, in order to reach the Owner.
Registration	The act of linking a QR Code to a user account on the Platform.
Service Period	The period of five (5) years that applies to a Package, running from the first Registration of any Label in that Package.

3. We do not sell to consumers

FindMyClubs does not sell Labels to consumers. Labels are supplied by us to independent dealers and retailers, who resell them in their own name and on their own account.

Any matter concerning your acquisition of Labels — including price, payment, delivery, returns, the statutory right of withdrawal, and any warranty or guarantee for the physical product — is solely between you and the dealer or retailer from whom you obtained them. We are not the seller of the Labels and are not a party to that purchase.

Our sole responsibility to you is to provide the Service described in these Terms.

4. Eligibility

To register and use the Service you must be at least 16 years old and capable of entering into a binding contract. If you are below the age at which you can validly consent on your own in your country of residence, you may use the Service only with the involvement of a parent or guardian.

5. The Service — how it works

The Service lets you make your equipment identifiable and recoverable. In summary:

• You register a QR Code on the Platform and create or use an account. No app is required.
• You choose what a Finder will see. You may link contact details (such as a phone number or email address), or you may keep your details private.
• If you share details, a Finder who scans your QR Code can contact you directly using the details you selected.
• If you keep your details private, a Finder can leave a message in the notice field on the Platform, and we will forward that message to the email address you provided at Registration, so you can decide whether and how to respond.

The Service is designed to help reunite you with lost equipment. It assists recovery but does not guarantee that lost equipment will be returned (see clause 14).

6. Service Period (five years)

Labels are supplied in Packages, each Package containing a set number of Labels (for example, a standard set of 17 Labels). A single Service Period of five (5) years applies to each Package.

The Service Period for a Package begins when the first Label from that Package is registered. That first Registration starts the five-year count for the whole Package. Registering further Labels from the same Package at a later time does not extend, restart or postpone the period — the count runs from the first Registration, not the last.

Accordingly, all Labels belonging to the same Package share one common Service Period, which ends five (5) years after the first Registration of any Label from that Package, regardless of when the remaining Labels are individually registered. Where you hold more than one Package, each Package has its own Service Period triggered by the first Registration of a Label from that Package.

After the Service Period expires, the registration and message-forwarding functions for the Labels in that Package may cease. We may, but are not obliged to, notify you in advance and offer a renewal or continuation option.

We may modify, suspend or discontinue the Service in accordance with clause 16. Where we do so during a Service Period that has already begun, we will act reasonably and will not deprive you of the essential benefit you registered for without giving notice and, where appropriate, an alternative.

7. Your account and security

• You are responsible for keeping your login credentials confidential and for activity under your account.
• You must provide accurate information and keep your contact email up to date — message forwarding depends on a valid, current email address.
• Notify us promptly of any unauthorised use of your account.

8. Acceptable use (Owners)

• Register only QR Codes on Labels you are entitled to use, for equipment you own or are authorised to manage.
• Do not use the Service for any unlawful purpose, or to store or transmit unlawful, infringing or harmful content.
• Do not attempt to access the Platform or other users' data without authorisation, or to disrupt or probe the Platform's security.

9. Finders

If you use the Service as a Finder, the following applies to you:

• By entering a message in the notice field, you ask us to forward it to the Owner and you consent to that forwarding.
• Provide accurate information and use the function only to help return equipment to its Owner.
• Do not use the function to send spam, advertising, harassing, offensive or unlawful content. We may filter, refuse or remove messages and may limit use to protect the Service and its users.

10. Personal data and privacy

Our handling of personal data is described in our Privacy Policy, which forms part of your use of the Service. In particular:

• As an Owner, you control whether to make contact details visible to Finders or to keep them private and rely on message forwarding.
• Where forwarding applies, we process the Finder's message and your email address solely to deliver that message.
• We retain registration and related data for the Service Period and as otherwise described in the Privacy Policy and required by law.

Because the Service is made available to you in exchange for the personal data you provide rather than for payment to us, it is treated as a consumer service for the purposes of mandatory information and fairness rules; these Terms are intended to comply with those rules.

11. Messages and user content

You retain any rights you have in the content you submit. You grant us a limited, non-exclusive licence to receive, transmit, store and forward that content only as necessary to operate the Service (for example, to deliver a Finder's message to an Owner). We do not claim ownership of your content and do not use it for unrelated purposes.

12. Intellectual property

The Platform and its content — including the FindMyClubs name and logo, text, design and software — belong to 21dcs spol sro/FindMyClubs or its licensors and are protected by law. You may use them only as needed to use the Service. You may not copy, modify, distribute or create derivative works without our permission.

13. Availability

We provide the Service with reasonable care and skill. We do not warrant that the Platform will be uninterrupted, error-free or always available, and we may carry out maintenance and updates. We are not responsible for failures caused by your device, connection, or third-party networks.

14. Liability

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law — including liability for death or personal injury caused by negligence, for intent or gross negligence, or under mandatory consumer-protection law. Your mandatory statutory rights are not affected.

Subject to the paragraph above, and because the Service is provided to you without charge by us:

• We do not guarantee that lost equipment will be found or returned; the Service is a recovery aid, not a recovery guarantee.
• We are not liable for a message that is not delivered, or is delayed, where this results from an incorrect or out-of-date email address, a Finder's error, or factors outside our reasonable control.
• We are not liable for indirect or consequential loss, or for loss of data, revenue or opportunity, arising from use of or inability to use the Service.

15. Suspension and termination

We may suspend or terminate your access if you materially breach these Terms, or where required for legal or security reasons. You may stop using the Service at any time. Termination does not affect rights or obligations that arose beforehand. Provisions that by their nature should survive (including clauses 11, 12, 14, 18) continue to apply.

16. Changes to these Terms

We may update these Terms from time to time. Each version carries a version number and date. We will make the current version available on the Platform and, for material changes, will take reasonable steps to notify registered users (for example, by email or a notice on the Platform). Changes do not apply retroactively, and for a Service Period already running they will not unfairly remove the core service you registered for. Continued use after a change takes effect indicates acceptance.

17. Consumer rights and dispute resolution

If you are a consumer, you benefit from the mandatory provisions of the law of your country of residence, and these Terms do not affect those rights.

If you have a complaint, please first contact us at info@findmyclubs.eu so we can try to resolve it. Regarding out-of-court dispute resolution: we are not currently obliged and are not willing to participate in proceedings before a consumer arbitration body, and you may also contact the competent consumer dispute-resolution body in your country.

18. Governing law and jurisdiction

These Terms and any dispute arising from them are governed by the law of the Czech Republic, and the courts of the Czech Republic shall have jurisdiction. If you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of residence, nor of the right to bring proceedings as permitted by applicable consumer law.

These Terms have been prepared in Czech and may be made available in other language versions for convenience. In the event of any discrepancy or inconsistency between language versions, the Czech version shall prevail and be binding.

19. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force, and the invalid provision will be replaced by a valid one that comes closest to its intended purpose.
